Terms of Service:

Simply J.D. & Co. is a Licensed, Bonded & Insured General Construction Company.

Note: Simply J.D. & Co. is referred to within this documentation as “we” & “our”.

Hourly Rates:

Start at $25.00 an hr. per man per job.

15% Shipping & Handling / Delivery fee for the total cost of parts / materials.

We will handle the purchases of ALL parts / materials needed for the work / job.

We will supply ALL parts / materials needed for the work / job to be done.

Prices are subject to change due to inflation or actual amount of products / parts used.

Any parts / materials left over are the property of Simply J.D. & Co. to do with as we wish.

Simply J.D. & Co. respects your privacy. We will not discuss or disclose contract terms or prices with others unless the proper legal documentation is presented.

By hiring or signing a contract with Simply J.D. & Co., you agree to respect our privacy by not discussing nor disclosing our prices / bid prices / estimates with anybody without written permission exclusively from Simply J.D. & Co..

Contract Pricing:

Bids / Estimates are VOID AFTER 30 DAYS.

We will charge a 15% Shipping & Handling / Delivery fee based on the total cost of parts / materials.

We will handle the purchases of ALL parts / materials needed for the work / job.

We will supply ALL parts / materials needed for the work / job to be done.

Prices are subject to change due to inflation or actual amount of products / parts used.

Any parts / materials left over are the property of Simply J.D. & Co. to do with as we wish.

We require a minimum payment of 50% of the total bid or 100% of the total cost of parts used, whichever is GREATER.

Simply J.D. & Co. respects your privacy. We will not discuss or disclose contract terms or prices with others unless the proper legal documentation is presented.

Service Calls:

Our Hourly Rates clause above applies.

Service Calls are billed out at a 4 hr. minimum

Office Time:

Office time is an hourly rate, therefore, our Hourly Rate clause applies. This includes, but not limited to billing & job related research. We reserve the right to charge office time as it applies to contract jobs. This is OVER & ABOVE the Bid Pricing & will be billed separately.

Billing, Payments & Collections -Hourly:

Payment is due upon completion of the work / job for any work under $250.00.

Any work over $250.00 will be billed out.

Statements are mailed out between the 1^st & 10^th of the month.

Payments are due before the 25^th of each month.

Late fees are applied after a statement becomes 14 days past due.

Statements that become 30 days past due are subject to a higher % late fee.

Statements that are 60 days past due are turned over for collections.

Uncollected debts due Simply J.D. & Co. are subject to a Construction Lien.

Billing, Payments & Collections -Contract:

Payment terms as per signed contract.

Statements are mailed out between the 1^st & 10^th of the month.

Late fees are implied after a statement becomes 30 days past due.

Statements that become 60 days past due are subject to a higher % late fee.

Statements that are 120 days past due are turned over for collections.

Uncollected debts due Simply J.D. & Co. are subject to a Construction Lien.

Permits:

Permits are the responsibility of Simply J.D. & Co..

Simply J.D. & Co. will provide proof of the permit cost.

100% of the cost of permits will be properly billed out / passed on to the customer.

100% of the cost of permits will be paid upfront to Simply J.D. & Co. before any work is started.

Permit costs are assumed to be separate from / not included in any estimate / bid given or signed by Simply J.D. & Co.

Permit costs included in an estimate / bid given or signed by Simply J.D. & Co. only covers that stated permit. Any other permit is treated as a separate entity and treated as stated above.

Simply J.D. & Co. will provide proof of the permit cost.

Change Orders:

See Appendix A Attached

Will be submitted to Simply J.D. & Co. in writing via Change Order Form.

On Contracts /Jobs UNDER $500.00 in total will inquire a service charge of $150.00 per Change Order.

On Contacts / Jobs OVER $500.00 in total will inquire a service charge of 20% of the NEW Contract / Job Total (Original Contact Total + Change Order Total + 20%) per Change Order.

More then one (1) Change Order: The above will apply in order as Change Orders are requested according to dates.

The 2^nd, 3^rd, etc. Change Order will be treated as a new Change Order and the “Original Contract Price” will be based from the proceeding Change Order.

Home Owner Involvement:

“Definition: Naturally, the homeowner wants the work performed just right and will interact regularly with the Service Provider. This interaction naturally includes on-site inspections, decisions and input into the construction or reconstruction and can add time and expense to the project.”

Contract / Job prices will not change for homeowner involvement.

Work outside the scope of any written contract / job description will result in a Change Order.

Homeowners will not redo, alter, fabricate, add to, dismantle, etc. any work without written permission from the Service Provider via Change Order.

Homeowners will not receive a discount for any hours they work.

Homeowners will NOT use or operate any of the Service Providers tools or equipment.

Homeowners will provide their own tools or equipment for their own use.

Homeowners will not hold the Service Provider, the Service Provider’s Employees, Sub-Contractors or Licensing Agency responsible for any injuries acquired as a result of Home Owner Involvement over and beyond as described above as “Definition”.

Violation of this Home Owner Involvement Clause will result in a service fee of $1000.00 per infraction, reimbursements of any time lost / added, reimbursements of any extra costs lost / added, plus the appropriate Change Order Fees.

Privacy Statement:

Simply J.D. & Co. respects your privacy. We will not discuss or disclose contract terms or prices with others unless the proper legal documentation is presented or a signed statement from the Customer.

By accepting an estimate or bid from Simply J.D. & Co., you agree to respect our privacy by not discussing nor disclosing our prices / bid prices / estimates with anybody without written permission exclusively from Simply J.D. & Co. or the proper legal documentation.

Simply J.D. & Co. Reserves The Right To:

Charge prevailing mileage using google.com as our mileage reference & using Goldendale, WA as our starting point.

Charge prevailing mileage PLUS $3.00 per mile using google.com as our mileage reference & using Goldendale, WA as our starting point in Storage Shed Contracts or when a Storage Shed is involved with our bid or work and /or where the term “storage shed” is used.

Charge the prevailing mileage rate to & from (both ways) a jobsite once in a 24 hr. period per vehicle per job.

Not to disclose our prices paid to our venders for products used.

Charge a 15% Delivery / Shipping & Handling Fee.

Void any signed contract via verbal or written / certified letter at any time upon our discretion.

Change prices of parts / materials due to inflation or actual amount of products / parts used.

Charge customer for ANY costs incurred, which are job / work related including, but not limited to fuel usage, mileage, ordering, returning, office time, billing, phone calls, etc..

Employ anybody that we see fit to do the job / work.

Send a worker(s) of our choice to any job that Simply J.D. & Co. is hired to do. Please don’t ask for your relatives to help.

Reschedule a work day at our convenience with NO notification to the customer.

Mark up any parts used for a job / bid by 35%.

Not reveal rental costs of rented items used for a job / bid.

Not reveal parts prices of any parts used for a job / bid.

Not to compensate / reimburse the customer for any parts paid for.

Not to compensate / reimburse the customer for any parts used.

Not to compensate / reimburse the customer for any parts not used.

Give any credits / refunds due to customer.

Not to Give any credits / refunds due to customer.

Not to compensate / reimburse the customer for any payments made.

Use the Barter / Trade System at our discretion.

Customers that insist on buying their own parts / supplies:

(This applies to both Hourly & Contract Pricing!)

(Hourly) -Will be billed an extra $20.00 an hr. per man per job for the entire working period of the work / job.

(Contract Pricing) -Will be billed the full bid price PLUS 50% the bid price in its entirety including cost of parts / materials, labor, shipping & handling / delivery, change orders, etc.

Will be billed $40.00 an hr. for ANY time spent sorting out parts orders, dealing with the suppliers, etc. (This includes time spent at the store, office time, driving time, etc.).

Will be billed $100.00 per incident per day PLUS any expenses incurred (This includes travel time, meals, mileage, etc).
